In Pennsylvania: your home improvement registration number must be on every written home improvement contract.

On quotes, contracts, and invoicesOn every contract, estimate and proposal. PA plus your number is enough, such as PA372
On your vehiclesOnly when the van carries an advert for the business. Then that advert must show the number. A plain van needs nothing
City rulesA city may ask for its own number as well. Ask the licensing office where the job is
If you forgetA contract without the number does not meet the law, and the customer can void it. Failing to register is a prohibited act under the state consumer protection law
Tax

10Does an HVAC contractor charge sales tax on labor in Pennsylvania? What is this?

In Pennsylvania, no sales tax on the bill. Furnaces, boilers, water heaters, heating fans and air conditioning systems become part of the building, so the job is a construction contract. The rest of the rules are below.

What this tax isPennsylvania sales and use tax. For HVAC installs you are treated as the final buyer of the equipment, so the tax is paid when you buy, not when you bill
Who pays tax on materials
  • You pay tax at the supply house on every furnace, boiler, condenser, air handler, duct and part you install in a building.
  • You do not charge the customer tax on them, even if you list them on the invoice.
  • If you buy out of state with no tax charged, you owe use tax to the state
Central AC and furnacesNo sales tax on the bill. Furnaces, boilers, water heaters, heating fans and air conditioning systems become part of the building, so the job is a construction contract
Window and portable units
  • You charge tax on the whole bill.
  • A window air conditioner or portable unit stays personal property, so you are selling it at retail.
  • The labor and delivery are taxed too, even when listed separately
RepairsNo sales tax. Repairing a building's heating or cooling system is a building repair service, which the state does not tax
Service contracts
  • Routine maintenance of a boiler or furnace, or of home air conditioning, is left out of the tax.
  • Routine maintenance of business air conditioning is a taxable building maintenance service.
  • A bill that mixes taxable maintenance with untaxed repair and does not split them is taxed in full
Tax-exempt customers
  • Working for a school, charity or government can let you buy some equipment tax-free.
  • The state's building machinery and equipment rule covers air conditioning for heating, cooling, cleaning, humidifying, drying and ventilation.
  • Anything outside the rule is still taxed to you
Do you register to collect tax?Not needed if all you do is installs and repairs. You need a sales tax license if you sell window units or parts at retail, or want to pay use tax directly
Tax rate6 percent state. 7 percent in Allegheny County. 8 percent in Philadelphia
Getting paid

11Getting paid: lien and notice deadlines for a Pennsylvania HVAC contractor What is this?

If you are not paid in Pennsylvania, a lien on the property is your backstop, but only if your notice goes out on time: a formal written notice to the owner at least 30 days before you file the lien, saying you intend to file (to file on December 1, the notice goes by November 1). Send it by first class, registered or certified mail.

  2. Day 30
    Send your notice

A formal written notice to the owner at least 30 days before you file the lien, saying you intend to file (to file on December 1, the notice goes by November 1). Send it by first class, registered or certified mail

Each day count is counted from the day the rule beside it names, which is not always the same day. Read the sentence under each one.

Who has to send a noticeA subcontractor, meaning anyone hired by the contractor rather than by the owner. A contractor hired by the owner sends no notice before filing
Send your notice byA formal written notice to the owner at least 30 days before you file the lien, saying you intend to file (to file on December 1, the notice goes by November 1). Send it by first class, registered or certified mail
File your lien byFile the lien with the county prothonotary (the civil court clerk) within six months after you finish your work (last day on the job June 1 means file by December 1). Then serve the owner with notice of the filing within one month after filing
Homes the owner lives inIf the owner or tenant lives in a house of one or two units, or a townhouse, and has paid the contractor in full, a subcontractor has no lien. Your claim is against the contractor only
Large projects
  • On a project costing $1,500,000 or more the owner can register it in the State Construction Notices Directory.
  • A subcontractor on a registered project must file a Notice of Furnishing on that website or lose lien rights.
  • The deadline is 45 days from first work

A lien needs a claim over $500. The lien is a legal claim on the property for money you are owed

Watch out

13What catches people out in Pennsylvania What is this?

The things people get wrong or do not expect about Pennsylvania, in a few sentences.

  • No state office licenses HVAC work in Pennsylvania. The state registers you as a home improvement contractor, and whether you need a trade license depends on the city you work in.
  • Philadelphia has no HVAC license at all. An HVAC company there needs the city's general Contractor License, $126 a year, with $500,000 of liability insurance and an OSHA 30 card.
  • Pittsburgh does license the trade. Its HVAC Trade license needs eight hours of training every year to renew, and the fee changes every year.
  • The state's own insurance floor is $50,000 for injury and $50,000 for property damage. That is the smallest policy that lets you register, not what customers or cities expect.
  • A furnace or central air install is not taxed on your bill. You pay tax on the equipment when you buy it. A window unit you sell and install is taxed on the whole bill, labor included.
  • Routine maintenance of a furnace or boiler, or of home air conditioning, is not taxed. Routine maintenance of business air conditioning can be, because the state taxes building maintenance services.
