Massachusetts HVAC license requirements and insurance

To work for yourself as an HVAC contractor in Massachusetts, you need the Master Refrigeration Technician, also called Refrigeration Contractor license. Massachusetts has 7 HVAC license types, and which one you need depends on the work you take on. The state sets no minimum liability insurance, and workers' comp is required. There is a credit check: no credit score, net worth or financial statement is named anywhere in the licensing law or the board's own pages for a refrigeration or sheet metal license. The state does not ask for a bond.

Insurance

5How much HVAC insurance do you need in Massachusetts? What is this?

Massachusetts sets no minimum liability insurance for this license. Customers and general contractors usually ask for $1,000,000 anyway. Workers' comp is required.

Minimum liability insuranceNone required by the state
Type of policy
  • Liability insurance with no dollar amount set.
  • A sheet metal worker asking for a permit must sign, under the penalties of perjury, that they carry it.
  • The refrigeration law and rules ask for none
Who this applies toSheet metal work. The homeowner can waive it by signing a waiver instead, but the board tells homeowners not to
If you will not do work for the publicRefrigeration work has no state insurance rule. Cities may still ask for a certificate before a permit, and most customers and general contractors will ask for one
Who must be named on the certificateNot named for sheet metal work. A sprinkler fitter contractor, a different license from the same bureau, must name the Division of Occupational Licensure and carry $500,000
Workers' comp required?Yes. Every employer in Massachusetts must carry it for their employees, whatever the hours or the head count
Who can opt out
  • If you work alone you do not have to cover yourself.
  • That covers a sole proprietor of an unincorporated business, a member of an LLC and a partner in an LLP.
  • An officer of a corporation who owns at least 25 percent of it can ask to be left out.
  • Anyone else you employ must still be covered
Workers' comp: what to knowIf you want cover for yourself, ask an insurance broker for it. The state does not sell it
Workers' comp: if you skip it
  • A stop work order that shuts the business until you have cover.
  • $100 a day for every day without cover, weekends and holidays included, and $250 a day if you appeal and stay open.
  • A criminal fine of up to $1,500, up to a year in jail, or both, and a three-year bar from public contracts
Money checks

Credit score you needNo credit score, net worth or financial statement is named anywhere in the licensing law or the board's own pages for a refrigeration or sheet metal license
If your score is lowerNone is asked for
How we knowThe refrigeration licensing rule, the sheet metal licensing rules and sections 81 to 89 of the refrigeration law have no section on credit, net worth, a financial statement or a surety
Bonds

7Does an HVAC contractor need a bond in Massachusetts? What is this?

Massachusetts does not require a state bond for this license. Some cities ask for one before they issue permits.

Does the state require a bond?No
AmountNone required by the state

The state does not ask for a bond (a promise, backed by an insurance company, that customers can be paid if you do not finish the job) for a refrigeration or sheet metal license. Home improvement contractors pay $100 to $500 into a Guaranty Fund instead of posting a bond, and most HVAC installers are left out of that program. Cities may ask for a bond before a permit, so check with your city.

Federal rules

8Federal rules that also apply What is this?

Rules from the US government that apply to an HVAC contractor in Massachusetts on top of the state's own.

EPA refrigerant certification
  • Anyone who services, repairs or disposes of equipment that could release refrigerant must hold an EPA Section 608 card.
  • Massachusetts goes further.
  • The journeyman refrigeration license asks for the Universal card before you can even sit the state exam
Showing your number

9Where must a Massachusetts HVAC contractor show the license number? What is this?

In Massachusetts: the same master license number goes on every offer, invoice, installation drawing and sheet of stationery the business uses.

On your vehiclesA master refrigeration technician with a regular place of business must show the master license number on every commercial vehicle. The lettering must be visible, legible and prominent
On quotes, contracts, and invoicesThe same master license number goes on every offer, invoice, installation drawing and sheet of stationery the business uses
On adsA master or journeyperson sheet metal worker's license type and number must be shown on any sign, listing or advertisement. A home improvement contractor's registration number must appear on every contract, permit and advertisement, if you hold that registration
If you forgetDiscipline against the license. No fixed fine was found
Tax

10Does an HVAC contractor charge sales tax on labor in Massachusetts? What is this?

In Massachusetts, no sales tax on your labor. The only services the state taxes are telecommunications services. The rest of the rules are below.

Tax rate6.25 percent statewide. Massachusetts has no city or county sales tax
LaborNo sales tax on your labor. The only services the state taxes are telecommunications services
Who pays tax on materials
  • You do.
  • Work that repairs or improves a building makes you the user of the duct, the furnace and the condenser you buy.
  • You pay the tax to your supplier and add no tax to the customer's bill.
  • If your supplier did not charge it, you owe the same amount to the state as use tax
Materials, when you quote one total priceOne price for the whole job means no tax on the bill, as long as the work repairs or improves the building. You already paid the tax when you bought the equipment
When you are selling equipment, not improving the building
  • Simply supplying and fitting a complete piece of standard equipment, such as a window air conditioner or a standard replacement unit, makes you a seller of that equipment rather than a builder.
  • Then you must show its price on its own and charge 6.25 percent on it.
  • If you roll it into one price instead, the whole bill is taxable when the equipment is worth more than a tenth of the total
Materials, when you list them separatelyIf you show the equipment and the labor as separate prices, you are selling the equipment. Charge the customer 6.25 percent on that line
Resale certificateOnly use a resale certificate, Form ST-4, for equipment you are reselling as a separate priced item. Never for equipment going into a job you price as one figure
Working for a tax exempt customerA job for a government body, a public school or a 501(c)(3) charity. Buy the building materials with a Contractor's Exempt Use Certificate, Form ST-5C, and Form ST-2 where it applies
Getting paid

11Getting paid: lien and notice deadlines for a Massachusetts HVAC contractor What is this?

If you are not paid in Massachusetts, a lien on the property is your backstop, but only if your notice goes out on time: if you have no contract with the general contractor, for example you supply a subcontractor, send a written notice of identification within 30 days of starting. Without it your lien is capped at what is still owed to the subcontractor above you.

The order things have to happen in, counted in days
  1. Day 0
Your first day on the job

    The clock starts here.

  2. Day 30
    Send your notice

If you have no contract with the general contractor, for example you supply a subcontractor, send a written notice of identification within 30 days of starting. Without it your lien is capped at what is still owed to the subcontractor above you

  3. Day 90
    File your lien

File your Statement of Account by the earliest of 90 days after a notice of substantial completion, 120 days after a notice of termination, or 120 days after the last day of work. With last work on June 1 and no other notices, file by September 29

Each day count is counted from the day the rule beside it names, which is not always the same day. Read the sentence under each one.

What to do
  • A Massachusetts lien is two filings at the registry of deeds for the county where the property is.
  • First a Notice of Contract, which creates the lien.
  • Then a Statement of Account, which says what you are owed and keeps the lien alive
Who has to send a noticeEveryone who wants a lien, including the general contractor. A subcontractor or supplier files a Notice of Contract and must also give the owner actual notice of it
Notice when you are a subcontractor
  • File your Notice of Contract by the earliest of three dates. 60 days after a notice of substantial completion is recorded. 90 days after a notice of termination is recorded.
  • Or 90 days after the last day anyone under the general contractor worked on the job.
  • If nobody records the first two, and the last work was June 1, file by August 30
Send your notice byIf you have no contract with the general contractor, for example you supply a subcontractor, send a written notice of identification within 30 days of starting. Without it your lien is capped at what is still owed to the subcontractor above you

Copy to the ownerThe lien only takes effect once you have filed the Notice of Contract and given the owner actual notice of it

Watch out

13What catches people out in Massachusetts What is this?

The things people get wrong or do not expect about Massachusetts, in a few sentences.

  • Massachusetts has no HVAC license. The state licenses the refrigeration side and the duct side as two trades, so one shop may need people licensed by two different boards.
  • The refrigeration journeyman license asks for the EPA Section 608 Universal card up front. You get the federal card first and the state license second.
  • The route to a refrigeration technician license is changing. The written rule still allows three shorter routes until November 8, 2026, but the Bureau's own page already asks for 6,000 apprentice hours plus 450 hours of study. Ask the Bureau which one it will take.
  • A master refrigeration technician must print the license number on every commercial vehicle, offer, invoice, installation drawing and sheet of stationery.
  • Installing central heating or air conditioning is left out of the home improvement contractor registration, so most HVAC companies never need the registration a remodeler needs.
  • Sheet metal licensing reaches only commercial duct systems, and neither the sheet metal board nor the refrigeration bureau asks for any continuing education.
  • The refrigeration licenses are cheap. $40, then $75, then $150 gets you from apprentice to running your own shop.
  • A sheet metal worker asking for a permit must swear they carry liability insurance, or get the homeowner to sign a waiver. No dollar amount is set.
